THESE PROMOTIONS ARE IN NO WAY SPONSORED, ENDORSED, ADMINISTERED BY, OR ASSOCIATED WITH discord, INC. ("discord"). YOU ARE PROVIDING YOUR INFORMATION TO CONSUMERBREAK® AND NOT TO discord. ALL QUESTIONS CONCERNING THE sweepstakes SHALL BE DIRECTED TO THE SPONSOR AT CONTACT@CONSUMERBREAK.COM.
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. PURCHASE OR PAYMENT TO PARTICIPATE IS NOT POSSIBLE AND DOES NOT INCREASE YOUR CHANCES OF WINNING.

These General Terms and Conditions are applicable to the Sweepstakes (as defined below) offered on or through http://www.consumerbreak.com (the "Website"), and any Discord channels and related services (collectively, such services, including any new features and applications, and the Website, the "Service(s)").
We reserve the right to change these Official Rules from time to time without notice as new features and upgrades affect the Promotion. You acknowledge and agree that it is your responsibility to review these Official Rules periodically to familiarize yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgment and agreement of the modified terms and conditions. The revised version will be effective at the time we post it and the modification date will be updated below.
These Official Rules are in effect as of January 10th, 2022.
1. ELIGIBILITY REQUIREMENTS
The Promotion is open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older, as well as any other countries whose laws allow sweepstakes. By using this website, interacting with our services, attempting to or receiving or purchasing NFTs, you represent and warrant that you are in compliance with all applicable laws in the jurisdiction where you are located. Further, you represent and warrant that you have reviewed all such applicable laws in your jurisdiction and your use of the website, the services, or interaction with our NFT products is not illegal.
In the event that you use our website, interact with our services, or attempt to or receive or purchase NFTs, and such activity is not lawful in your jurisdiction, you agree to indemnify us and hold us harmless for any liability (including any governmental investigation) that we may incur related to your activities. Your indemnification obligation includes your liability for all related costs and fines, as well as reasonable attorneys fees that we incur in relation to your activities.
If you do not agree to these terms, you may not use the website, interact with our services, attempt to or receive or purchase NFTs.
Employees, contractors, directors and officers of Concept and Innovation Group, LLC ("Sponsor"), its parent, subsidiary and affiliated companies, and the web design, advertising, fulfillment, content approving and promotion agencies involved in the administration, development, fulfillment and execution of this Sweepstakes (collectively, "Sweepstakes Parties"), and the immediate family members of each such person (spouse, parent, child, sibling, grandparent, and spouse of "step" of each) and those living in the same household of each such person (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Sweepstakes) are not eligible to enter or win.
2. PROMOTION ENTRY PERIODS
From time to time, raffles will be posted into any of the channels in the ConsumerBreak Discord server. Every raffle that is offered will run as its own separate Sweepstakes. The Sweepstakes Period, prizes, number of winners, and any other information about the raffle will be labeled on each post. The server hosting the Sweepstakes is the official clock for these Sweepstakes.
3. HOW TO enter
Submit our Whitelist Form to be eligible to receive raffle prizes. Join the ConsumerBreak Discord Server. You will need to obtain a “BREAK PASS” NFT in order to have access to the Break Pass Channel, and you will need to obtain a “Hybrid Creature” NFT in order to have access to the Hybrid Holder Channel.
To enter you must have Internet access and a valid whitelisted WAX Address & Discord username. Automated methods of participation are prohibited and any use of automated devices will cause disqualification, termination, and possible legal action. In the event of a dispute regarding the identity of the participant, the natural person associated with the Discord username provided at the time of entry will be considered the participant. Participants may not register multiple times. Any participant who attempts to enter with multiple accounts will be disqualified and forfeits any and all prizes won, and may be prosecuted to the full extent of the law, in Sponsor's sole discretion. By participating, you agree to abide by and be bound by these Official Rules.
For any of the ConsumerBreak Discord channels, specially marked posts indicating raffles will say when a drawing will take place, how many prizes will be paid out, and how many winners there will be.
To enter, “react” to the raffle post with with the specified Emoji using Discord’s Reaction tool.
4. PRIZES
Types and number of prizes are the sole discretion of Sponsor for any given raffle. Winners will include randomly selected people using an online randomizing tool who have reacted to the raffle’s post in Discord during the specified timeframe.
All winner final decisions are at the sole discretion of Sponsor.
5. WINNER NOTIFICATION AND PRIZE CLAIM
Winners are subject to verification, including verification of age and identification. In the event of non-compliance with these Official Rules, the prize will be forfeited and your account may be terminated, with possible legal action taken.
Once you’ve won a prize, you will receive contact from Sponsor to the contact email address that you have associated with your Discord username on the Whitelist Form. Once you are contacted, you may receive your prize by providing any necessary delivery information. In some cases prizes may be awarded by email or to your WAX Address (e.g. a digital coupon, PayPal Cash, NFTs or cryptocurrency), with no response needed from you. The information you provide must be your own.
You will have 30 days to redeem a prize from the time that it was won by responding to Sponsor’s communication via e-mail, if required. Sponsor is not responsible for your failure to respond within the 30-day period. Failure to respond within the 30-day period may forfeit any and all prizes won.
Your Discord username may be displayed in winner announcements on the Sponsor social media pages (Facebook, Twitter, Instagram), winner announcement posts in Discord, or our website at consumerbreak.com/winners.
6. WINNERS LIST
The winners list may be posted on the official Sponsor social media pages as the winners are determined (Facebook, Twitter, Instagram, Discord), or on the Sponsor website at consumerbreak.com/winners. Your Discord Username will be displayed on these winners lists. You may also request to see a winners list for any game by emailing Sponsor at contact@consumerbreak.com.
7. TAXES
All federal and state taxes are the responsibility of the prize winners. If you have received a total of over $600 in any given year from any one sponsor or brand partner (including NFTs based on their value at the time of prize win), you will receive a completed IRS Tax Form-1099 at the end of the calendar year. If you have received payments of more than $580 from raffles or other contests, you will not be able to receive further payment from each corresponding brand partner for the remainder of the calendar year unless and until you provide us with a completed and verified IRS Tax Form-W-9 or foreign equivalent. We will ask you for this information as you reach this limit.
8. GENERAL CONDITIONS
No substitution and no transfer of prizes is offered, except at the sole discretion of the Sponsor. By participating, participants agree to these Official Rules and the decisions of the Sponsor, which are final and binding in all respects. Winners are solely responsible for any and all federal, state and local taxes on prizes. Information obtained at registration is subject to Sponsor’s Privacy Policy. If for any reason the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible, and to cancel, modify or terminate the Promotion. CAUTION: ANY ATTEMPT BY YOU OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL OR ENTITY TO THE FULLEST EXTENT PERMITTED BY LAW. This Promotion is offered only in the United States and is governed by the laws of the State of Maryland, and all claims must be resolved in the federal or state courts in Washington County, MD.
9. LIMITATIONS OF LIABILITY AND RELEASE
No liability or responsibility is assumed by Sponsor or Promotion Parties resulting from participation in, or attempt to participate in, the Promotion, or the download of any information in connection with participating in the Promotion. No responsibility or liability is assumed by the Sponsor or Promotion Parties for technical problems or technical malfunction arising in connection with any of the following occurrences, without limitation, that may affect the operation of the Promotion: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent to or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Promotion Website in whole or in part for any reason; traffic congestion on the Internet or Promotion Website; unauthorized human or non-human intervention of the operation of the Promotion, including without limitation, unauthorized tampering, hacking, theft, virus, bug, worm; or destruction of any aspect of the Promotion. Sponsor and Promotion Parties are not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Promotion Website. Use of the Promotion Website is at user’s own risk. Sponsor and Promotion Parties are not responsible for any personal injury or property damage or losses of any kind that may be sustained to user's or any other person's computer equipment resulting from participation in the Promotion, use of the Promotion Website or the download of any information from the Promotion Website. By participating in the Promotion, the participant agrees (and agree to confirm in writing):
(a) to release Sponsor and Promotion Parties from any and all claims, loss, damages or liabilities (“Claims”) incurred with respect to participant’s participation in the Promotion and the awarding, receipt, possession, and/or use or misuse of any prize, including any traveling related thereto. By accepting a prize, recipient agrees to release and hold Sponsor, Promotion Parties, and all of their respective officers, directors, employees, representatives and agents harmless from any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Promotion; and from acceptance, possession, misuse or use of a prize including but not limited to liability for taxes, duties or other levies assessed upon any of the prizes;
(b) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of- pocket expenses;
(c) all causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action; and
(d) any and all claims, judgments, and award shall be limited to actual out-of- pocket costs incurred, excluding attorneys’ fees and court costs. Except in Tennessee, and where prohibited by law, by accepting a prize, winner grants permission for Sponsor, Promotion Parties, and those acting under their authority to use his/her name, photograph, voice and/or likeness, for advertising and/or publicity purposes, in any and all media now known or hereinafter invented without territorial or time limitations and without additional compensation.
(e) to the maximum extent permitted by law, participant agrees to waive any right to participate in or initiate or otherwise be a part of any class action against Sponsor. This waiver includes any judicial proceedings, as well as any alternative dispute proceedings (such as arbitration) that may be conducted on a class basis.
