These General Terms and Conditions are applicable to the Promotion (as defined below) offered on or through http://www.consumerbreak.com (the "Website") and any mobile applications and related services (collectively, such services, including any new features and applications, and the Website, the "Service(s)").
We reserve the right to change these Official Rules from time to time without notice as new features and upgrades affect the Promotion. You acknowledge and agree that it is your responsibility to review these Official Rules periodically to familiarize yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgment and agreement of the modified terms and conditions. The revised version will be effective at the time we post it and the modification date will be updated below.
These Official Rules are in effect as of March 13, 2020.
1. ELIGIBILITY REQUIREMENTS
The Promotion is open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older. Employees, contractors, directors and officers of Concept and Innovation Group, LLC ("Sponsor"), its parent, subsidiary and affiliated companies, and the web design, advertising, fulfillment, content approving and promotion agencies involved in the administration, development, fulfillment and execution of this Promotion (collectively, "Promotion Parties"), and the immediate family members of each such person (spouse, parent, child, sibling, grandparent, and spouse of "step" of each) and those living in the same household of each such person (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Promotion) are not eligible to enter or win.
2. PROMOTION ENTRY PERIODs
There is a series of tournament “rounds” to enter and compete in, with only the top players of each round continuing to the next. All eligible users as described in Rule #1 may enter the opening round called “SELECTION BREAK”. This contest will conclude on March 18th, 2020 and the leaderboard will be determined and divided into five (5) “Skill Rank” tiers based on users’ personal cumulative average score as described in Sponsor’s ConsumerBreak® Official Rules. Each of these Skill Rank Leaderboards will then become a separate tournament with the same identical remaining rounds, but with different competitors of each Skill Rank.

The server hosting the Promotion Website is the official clock for these Promotions.
3. HOW TO PLAY
Download the free app “ConsumerBreak” from the Apple App Store (iOS devices) or Google Play Store (Android devices). Open the app and register by inputting a Contact Email and Leaderboard Name and tapping to look at the Terms and Rules. After logging in, you will see a Home screen with thumbnails for different games.
To play you must have Internet access and a valid registered account, which is associated with your mobile device after your first login. Automated methods of participation are prohibited and any use of automated devices will cause disqualification, termination, and possible legal action. In the event of a dispute regarding the identity of the participant, the natural person associated with the device account provided at the time of registration will be considered the participant. Participants may not register multiple times on the same device, nor may participants use any other device or artifice to register multiple times. Any participant who attempts to log in with multiple accounts or uses any device or artifice to register multiple times will be disqualified and forfeits any and all prizes won, and may be prosecuted to the full extent of the law, in Sponsor's sole discretion. By participating, you agree to abide by and be bound by these Official Rules.
The play rules are as follows:
During the SELECTION BREAK entry period, a thumbnail labeled “SELECTION BREAK” will be visible on the Home screen with a “Begin” button. Tap on this button or on the image thumbnail to start playing.
For contest rounds after SELECTION BREAK, the respective top scores of each previous round will receive a special password to enter the next rounds via email and push notification. In the remaining 6 hours of each contest, the Sponsor will send reminders to qualified participants who have not yet entered. Sponsor is not responsible for users not entering their scores within the given timeframe.
You can contact Sponsor at any time during the Promotion at contact@consumerbreak.com with questions or to receive the required password if you are a verified qualified participant for the ongoing contest round.
Once obtaining a password, tap on the app menu button at the top right of the Home screen, then tap “Password Game Entry”, and then input the required password for the live contest round. After entering the correct password, the game will open up for play and will be visible as a thumbnail on the Home screen to access again later.
You can tap the “i” (INFO) button on any contest thumbnail or “Begin” screen to see information about the contest such as the prizes and how to win.
Once entering a contest, you will be given a puzzle (a “Level”) to complete. To enter your “Play” for the game, tap on “Begin” and take as long as you need to finish the puzzle by assembling all of the pieces together.
The 4 corner pieces of the image will be displayed on the screen. You must reassemble the rest of the “broken” pieces as quickly as you can. A puzzle piece will be presented in the middle of the screen for you to drag to the correct spot. You may rotate the piece in 90° intervals by tapping on it. Once the piece is placed in the correct location and at the correct rotation, a new piece will be presented. You may also tap on the "Pass" button to skip the piece in play to be cycled around later. To view the full image at any time for reference, hold down the “Hold to view image” button. The timer will continue running while you view the image.
When the image is fully put back together, the time that you spent solving the puzzle is recorded for the contest and will appear on the live leaderboard by order of time score with the shortest at the top. Tap anywhere to break the image apart and continue. This is all that is required to enter, but you may now solve the puzzle again up to 9 more times to get a faster time score for the contest leaderboard. The image will stay the same for all attempts, but the puzzle piece pattern will be randomized for every attempt. Limit ten (10) attempts per person per game. If you Restart the attempt or leave the app during the puzzle solve, you will forfeit that attempt. Your fastest time score out of all attempts at the end of the contest entry period will be deemed your Time Score for the game. The Begin Screen will display your current best time score.
Within 6 hours of each contest round’s conclusion, the leaderboards will be determined and posted by Sponsor at consumerbreak.com/madness (linked at “Winners” page in app menu) and passwords sent to respective qualified participants for the next round.
The Sponsor’s servers hosting the game software are the official clock for these Promotions. All winner and leaderboard final decisions are at the sole discretion of Sponsor.
4. PRIZES
All participants from FIELD BREAK ROUND 1 will win a total of $1.00 for every additional contest round that they enter.
5 winners (TOP 1 SCORE of each Skill Rank from “CHAMPIONSHIP BREAK”) will each win (1) Ticketmaster gift card with a value of $100.
Prizes will be paid out at the time of leaderboard and winners list posting.
These prizes are subject to increase in quantity and value at the sole discretion of Sponsor depending on the amount of participation in the SELECTION BREAK contest entry period. If these prizes change, they will be updated on the contest INFO menu, these Official Rules, and on social media announcements.
5. WINNER NOTIFICATION AND PRIZE CLAIM
Winners are subject to verification, including verification of age and identification. In the event of non-compliance with these Official Rules, the prize will be forfeited and your account may be terminated, with possible legal action taken.
Once you’ve won a prize, you will receive payment from Sponsor to the Contact Email address that you have saved in the App Menu.
CHAMPIONSHIP BREAK winners will receive the Ticketmaster gift cards as digital e-cards via email.
Cash winnings are paid out via PayPal®. If your Contact Email is not a verified PayPal® account email, you will receive an email from PayPal® to redeem the winnings. You will need to open this email and click the button to login with PayPal® and receive the winnings. You will have 30 days to redeem a prize from the time that it was won by claiming it in the email from PayPal®. Sponsor is not responsible for your failure to respond within the 30-day period. Failure to respond within the 30-day period may forfeit any and all prizes won. If you have a verified PayPal® email address entered as your Contact Email, then prize payouts will appear instantly in your PayPal® Balance without any action required from you. If your Contact Email is a verified PayPal® email address, there will be no fees associated with the prize transfer. If your Contact Email is not a verified PayPal® email address and you are claiming the prize from inside the email from PayPal®, a small fee may be deducted from your prize amount for the transfer. See PayPal®’s terms for more information.
6. WINNERS LIST
All contest round leaderboards will be posted on the official Sponsor social media pages as they are determined (Facebook, Twitter, Instagram), or on Sponsor’s brand partner social media pages or other media, as well as the official tournament results page consumerbreak.com/madness. This Winners page link is found in the app menu. Your Leaderboard Name that is saved in the App Menu will be displayed on these winners lists and leaderboards. You may also request to see a winners list for any game by emailing Sponsor at contact@consumerbreak.com. After contest rounds are concluded and leaderboards posted, the passwords will be released for others to play for fun through the duration of the Promotion.
7. TAXES
All federal and state taxes are the responsibility of the prize winners. If you have received a total of over $600 in any given year from any one sponsor or brand partner (including Sponsor of this Promotion), you will receive a completed IRS Tax Form-1099 at the end of the calendar year from each corresponding brand partner that has delivered you those prizes. If you have received payments of more than $580 from any one sponsor or brand partner, you will not be able to receive further payment from each corresponding brand partner for the remainder of the calendar year unless and until you provide the corresponding sponsor or brand partner with a completed and verified IRS Tax Form-W-9.
8. GENERAL CONDITIONS
No substitution and no transfer of prizes is offered, except at the sole discretion of the Sponsor. By participating, participants agree to these Official Rules and the decisions of the Sponsor, which are final and binding in all respects. Winners are solely responsible for any and all federal, state and local taxes on prizes. Information obtained at registration is subject to Sponsor’s Privacy Policy. If for any reason the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible, and to cancel, modify or terminate the Promotion. CAUTION: ANY ATTEMPT BY YOU OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL OR ENTITY TO THE FULLEST EXTENT PERMITTED BY LAW. This Promotion is offered only in the United States and is governed by the laws of the State of Maryland, and all claims must be resolved in the federal or state courts in Washington County, MD.
9. LIMITATIONS OF LIABILITY AND RELEASE
No liability or responsibility is assumed by Sponsor or Promotion Parties resulting from participation in, or attempt to participate in, the Promotion, or the download of any information in connection with participating in the Promotion. No responsibility or liability is assumed by the Sponsor or Promotion Parties for technical problems or technical malfunction arising in connection with any of the following occurrences, without limitation, that may affect the operation of the Promotion: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent to or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Promotion Website in whole or in part for any reason; traffic congestion on the Internet or Promotion Website; unauthorized human or non-human intervention of the operation of the Promotion, including without limitation, unauthorized tampering, hacking, theft, virus, bug, worm; or destruction of any aspect of the Promotion. Sponsor and Promotion Parties are not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Promotion Website. Use of the Promotion Website is at user’s own risk. Sponsor and Promotion Parties are not responsible for any personal injury or property damage or losses of any kind that may be sustained to user's or any other person's computer equipment resulting from participation in the Promotion, use of the Promotion Website or the download of any information from the Promotion Website. By participating in the Promotion, the participant agrees (and agree to confirm in writing):
(a) to release Sponsor and Promotion Parties from any and all claims, loss, damages or liabilities (“Claims”) incurred with respect to participant’s participation in the Promotion and the awarding, receipt, possession, and/or use or misuse of any prize, including any traveling related thereto. By accepting a prize, recipient agrees to release and hold Sponsor, Promotion Parties, and all of their respective officers, directors, employees, representatives and agents harmless from any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Promotion; and from acceptance, possession, misuse or use of a prize including but not limited to liability for taxes, duties or other levies assessed upon any of the prizes;
(b) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of- pocket expenses;
(c) all causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action; and
(d) any and all claims, judgments, and award shall be limited to actual out-of- pocket costs incurred, excluding attorneys’ fees and court costs. Except in Tennessee, and where prohibited by law, by accepting a prize, winner grants permission for Sponsor, Promotion Parties, and those acting under their authority to use his/her name, photograph, voice and/or likeness, for advertising and/or publicity purposes, in any and all media now known or hereinafter invented without territorial or time limitations and without additional compensation.
